You will be fined exactly this amount, if you are caught with 1/10 of a gram. Marijuana consumption is officially legal in Georgia, but its’ purchase, keeping and transportation is prohibited by the law in every way. Yes, it doesn’t make sense, hence these logical questions:

1. What are the circumstances of smoking freely?

Only in case you are already 21 years old, you are at home ( or at your friend’s home etc) and no underage person is present. And also you shouldn’t have even the tiniest amount of marijuana in your pocket or in your house.

2. Where is it illegal to smoke?

As you may already have figured, anywhere except your house. The fine for smoking in public places is between 800 and 1200 GEL.

3. Who isn’t allowed to smoke?

Everyone under 21. The fine for smoking for anyone underage is between 500 and 1500 GEL. It’s forbidden to smoke while on duty – The fine for smoking during work is between 1000 and 1500 GEL. Moreover, if your line of work has anything to do with particular danger or people’s lives and well-being, then in addition to the fine, your work license will be seized.

4. What else is prohibited?

Almost everything. For example:

  • Being under the influence of marijuana in presence of an underage person – a fine between 1000 and 1500 GEL
  • Encouragement or persuasion of an underage person to smoke – 6 to 10 years in prison
  • Encouragement or persuasion of two or more people to smoke – also 6 to 10 years in prison
  • Driving a vehicle under the influence – Keep in mind, that unlike a case involving alcohol, this is a criminal law offence punishable by a fine or a year in prison. In addition, if you break any rules or cause harm to anyone, the penalty gets stricter in accordance with the scale of the incident
  • Popularization – Even though it’s unclear, what may be regarded as popularization, still remember, thatmarijuana popularization–advertising penalty for individuals is between 5000 and 10000 GEL, for legal entities – between 10000 and 20000 GEL

5. What happens in case of purchase, keeping or transportation?

Purchase, keeping and transportation are all considered a crime. It depends on the amount.

So: From 5 to 70 grams is a small amount, more than 70 – large amount.

You will be able to escape with a fine only in case of purchase, keeping or transportation of a very small amount, meaning less than 5 grams dried out and less than 10 grams raw marijuana.

If you purchase, keep or transport less than 70 grams of dried out or less than 100 grams of raw marijuana, you will be charged by criminal law. However the penalty is unknown. Imprisonment is abolished, but the penalty is undetermined.

In cases of large amounts, meaning more than 70 grams of dried out marijuana, the penalty is imprisonment.

6. What happens, if I’m caught with one “Masra”?

7. What should I keep in mind, if I want to grow it at home?

There’s no imprisonment for it, however the penalty is undetermined. Plus, like in any other case, it depends on the amount. In short, it means that the plant itself shouldn’t weigh more than 266 grams, raw leaves – more than 100 grams, dried out – more than 70 grams. Remember, purchase, keeping or transportation of any larger amount than the mentioned numbers is punishable by imprisonment.

8. What else should I consider?

  • If you already have an administrative fine or have been convicted for purchase, keeping or transportation, the penalty gets stricter.
  • If you aren’t yet 21 years old and have been caught consuming for the second time, the penalty is doubled – between 1000 and 1500 GEL
  • The penalty gets doubled for consumption in a public place for a second time as well – between 1200 and 1500 GEL.
  • Anywhere transportation is mentioned, it includes transferring (sending) it as well.
